A Vermont man is in a legal fight with Chick-fil-A, over cabbage and his t-shirts. KJZZ's Al Macias reports.
AL MACIAS: Bo Muller-Moore has been making and t-shirts that say "Eat More Kale" for more than a decade. Kale is a green leafy vegetable from the cabbage family. The Chick-fil-A restaurant chain says his slogan infringes on the company's catchphrase, "Eat More Chikin." The U.S. Patent and Trademark office agrees. It has issued a preliminary decision saying there's likelihood people would confuse the sources of the two phrases. Chik-fil-A says its "Eat More Chikin" phrase has been used for 16 years, and the company must protect its trademarks in order to maintain rights to the slogan. Muller-Moore says he still plans to apply for his own "Eat More Kale" trademark.
