Controversy in the Ninth Circuit

The U.S. Senate approved Andrew Hurwitz for the Ninth Circuit Court of Appeals after a three-month delay. Richmond University law professor Carl Tobias explains the controversy behind the nomination.

Tobias says Hurwitz moved forward on the narrowest of margins, receiving 60 votes, the exact number he needed. He says the Ninth Circuit is a piñata for conservatives. Republicans have questioned Hurwitz’s ability to be objective due to comments Hurwitz made in regard to Roe v. Wade.
