Feds' Lawsuit Challenging Airline Merger May Not Go To Trial

It has not been the best week ever for American Airlines and US Airways. A federal bankruptcy judge said he is not sure he can approve American’s plan to come out of bankruptcy protection after the federal government and a handful of states including Arizona filed suit, challenging the carrier’s merger with Tempe-based US Airways.

Dan Goldfine chairs the Anti-Trust Practice Area at the law firm Snell and Wilmer. Before that he was a trial attorney with Department of Justice’s Anti-Trust Division. He said the feds’ lawsuit surprised him and thinks they will have a tough time proving their case. We asked him if he thinks the lawsuit is really meant to stop the merger.
