The Arizona Supreme Court ruled on Thursday that capital murder defendants will have a right to the pretrial hearing to challenge their fate. The hearing by the grand jury will decide which factors in the case can be given to the trial jury to consider when handing down a death sentence. This decision has come down after the Yavapai County Court denied a capital murder defendant such a hearing.
