Judge To Consider Whether To Release Border Agent's Name

A hearing tomorrow could determine whether the name of a Border Patrol agent, accused in the shooting of a Mexican teen two years ago, remains confidential. 

The family of the teen wants the agent’s name made public and a judge will consider the agent’s request that it and other information in the case be kept under wraps.

Attorneys for the family of 16-year-old Jose Antonio Elena Rodriguez, have been provided the agent’s name on the condition it be kept confidential. The family is suing the agent, after the teen was shot and killed across the border, at Nogales, in 2012.

The Border Patrol says the boy was throwing rocks at agents across the border when he was shot. The family contends the teenager was just walking home.

Federal officials said last month the case remained under investigation.
