Maricopa County Attorney Bill Montgomery is asking the U.S. Supreme Court to hear a case about a voter-approved law that denies bail to undocumented immigrants.
The law was deemed unconstitutional by the 9th circuit court of appeals last month. Two weeks ago, the U.S. Supreme Court denied Montgomery’s request to keep the law in place until the court heard a case about it.
“What this does for us in Arizona at this point is basically remove every tool that we’ve had to try to deal with the criminal impact of violations of federal immigration law on our community and our state," Montgomery said. "It underscores what I will now say is the dire need for us to have immigration reform at the federal level.”
Montgomery hasn’t submitted the writ of certorari to the Supreme Court yet. Once he does that, the court will decide whether or not to hear the case.
