Attorney On Uncounted Provisional Ballots In Arizona Elections

Arizona Secretary of State Ken Bennett, along with other elected officials, issued the official canvass of the 2014 election results on Monday. In most years, that puts an end to the campaign season.

But this is not most years and in one race, the canvass appears to be just another step in the campaign. That race is for Congress, in southern Arizona’s 2nd District, between Democratic incumbent Rep. Ron Barber, and Republican challenger Martha McSally.

The results show McSally with a lead of 161 votes.

One of the contested issues in the 2nd District race has been over uncounted provisional ballots.

Jon Sherman, a staff attorney at the Washington, D.C.-based Fair Elections Legal Network, has written and testified about that issue.
