The Maricopa County Attorney says he is saddened and frustrated by a ruling from the state Supreme Court. The ruling involves a bid to retry a former death row inmate.
The Supreme Court has ruled against a new trial for Debra Milke, in the death of her 4-year-old son.
Prosecutor Bill Montgomery says that’s leaving people with the gross misimpression that prosecutors did something wrong 25 years ago.
A disappointed Montgomery said there were good reasons to ask the Supreme Court to grant another trial.
“There was ammunition in the defendant’s purse when it was impounded, that was never inventoried. That ammunition matched the ammunition that was used to kill Christopher Milke," Montgomery said.
Debra Milke sat on death row for 22 years, after being convicted of first degree murder in her son’s death. She was freed two years ago, after an appeals court threw out the confession she allegedly made to a now-retired Phoenix police detective. That confession was witnessed solely by the officer and was not recorded.
