Subpoena Proceedings Against APS Delayed

The showdown between a state utility regulator and Arizona Public Service over its political donation records has been delayed.

Arizona Corporation Commissioner Bob Burns subpoenaed the records of APS parent company Pinnacle West over allegations of contributions in the 2012 Corporation Commission election.

The commission initially vetoed Burns’ effort to hire an attorney to review the documents but reversed course last week after Pinnacle West asked a judge to quash the subpoena. But Burns said he’s not ready for the court hearing set for early October.

"We said we would stay the subpoena action until later if they would extend the time for us to find [an] attorney," he said.

All legal proceedings are still expected to take place. They have not yet been rescheduled.
