Appeals Court To Hear Arguments On Provisional Ballots Cast At Wrong Polling Place

A federal appeals court will hear arguments today on whether provisional ballots filed at the wrong polling place on Nov. 8 should be counted in Arizona this election.

In past elections, these ballots have been thrown out, but Democrats argue this practice disenfranchises voters and is unconstitutional.

This was an issue in the Congressional District 5 primary recount because some voters said they were not informed by poll workers that their provisional ballots would not count if cast in the wrong precinct.
