Attorney General: Tucson Destroying Guns 'May Violate' State Law

The Arizona Attorney General is agreeing with a Southern Arizona lawmaker in saying Tucson may be breaking state law by destroying guns that have been turned over to police.

In his report, Attorney General Mark Brnovich agreed with a complaint filed by state Rep. Mark Finchem that by destroying the guns, the city ordinance “may violate” one or more state laws.

Finchem filed the complaint in October stating that Tucson is violating a 2013 Arizona law requiring the sale of otherwise legal guns obtained by law enforcement agencies.

Tucson officials argue that destroying firearms is legal because it is a local issue involving municipal property.

Brnovich did not indicate in his report whether he will pursue any further legal action.
