Arizona Senate To Vote On Mandatory DUI Tests For Drivers Who Cause Fatal Crashes

The Arizona Senate is set to vote on SB 1054 Thursday. That's the bill making DUI tests mandatory for drivers involved in a fatal crash.

The original bill required all drivers be tested, but a scaled back version of the bill limited testing to only the person police suspect caused the crash.

It was introduced on behalf of Phoenix Horizon High School graduate Joe Smith and his parents. The 18-year old was struck and killed by a semi-truck driver last June.  

The driver told a state trooper he was tired, but was never tested for drugs or alcohol.
