The U.S. Supreme Court is expected to decide Monday on a landmark case in a cross border shooting out of Texas. The court's decision will impact a similar case in Arizona.
The issue is not whether a Border Patrol agent in El Paso killed a 15-year-old boy. Rather, it’s whether the teen was protected by the U.S. Constitution as a Mexican national when the agent shot him as he played on Mexican soil.
The U.S. Supreme Court could decide to overturn last year’s 5th Circuit Court of Appeals’ ruling, which determined the U.S. Constitution did not protect the boy and that his parents did not have a claim.
The high court’s ruling could impact an Arizona case involving a border agent who shot a 16-year-old Mexican national in 2012.
In that case, an agent in Nogales fired ten shots through a border fence into the back of the boy and killed him.
Attorneys for the agent claim the boy was throwing rocks at the border patrolman.
