Flake: DACA Decision Should Be In Hands Of Congress, Not President

As the White House ponders whether to rescind the Deferred Action for Childhood Arrivals program, Arizona’s junior senator is working to make the measure permanent.

In addition, Sen. Jeff Flake believes the DACA decision should be in the hands of the legislative branch and not the president.  

Flake has supported the so-called Dream Act for years and continues to introduce legislation in the Senate that would officially put the law on the books.

He maintains that under the Constitution, it’s up to Congress to decide.

“We argued that when President Obama took this action (in 2012) that it wasn’t constitutional. It’s not constitution for this president take it either, to just allow it to go. So, he needs to come the Congress," Flake said.

Although no action has yet been taken by the Trump administration, some reports indicate the president may use the threat to eliminate DACA as a bargaining chip to get funding for his proposed border wall.
