The Arizona Supreme Court will not overturn Arizona Public Service's latest utility rate increase.
For weeks, Bob Burns has fought his fellow Corporation Commissioners against APS' 3.3 percent rate hike.
He lost that fight, and on Tuesday lost again when the high court decided not to intercede.
Burns' chief complaint was the lack of transparency. Specifically, he wanted to know who on the commission received large campaign donations from APS.
But, his fight is not over.
Another case in a Maricopa County Superior Court is scheduled for a hearing later this week.
Burns will ask the court to rule on whether he had the right to subpoena APS records to determine if the utility company is entitled to collect an additional $7 million a month from its customers.
That sum averages about $7 more per month per customer.
If the county court rules in favor of Burns, the judge could require the entire case be reheard, with APS testimony and documents that were originally withheld.
