The Arizona Supreme Court agreed Tuesday to decide whether students with DACA status are eligible for in-state tuition.
The justices said they’ll hear arguments from both the Maricopa County Community College District, which has given the reduced tuition, and Attorney General Mark Brnovich, who opposes the district’s policy.
For the moment that’s a victory for the college and students in the Deferred Action for Childhood Arrivals, or DACA, program.
The justices will review a ruling last year from the Court of Appeals saying those students aren’t allowed the cheaper tuition because of their residential and legal status.
The state Supreme Court has not yet set a date for a hearing on the arguments.
