Organizers of the Invest In Ed initiative have asked a Maricopa County Superior Court judge to force lawmakers to rewrite the description of the measure which is headed to voters this Fall.
Attorney Jim Barton, representing the Invest in Ed initiative, said the ballot measure which seeks to hike income taxes on earnings of more than $250,000 will not affect a 2015 law which indexes tax brackets to account for inflation.
However, that is what the Republican-controlled Legislative Council voted to tell voters last month. Barton said their description of the initiative purposely misleads voters.
"I think it was done on purpose and I think it's a bad bargain because I think they know the statute doesn't do that," Barton said. "You can tell from our pleading that it's pretty clear it doesn't do what they say it does."
According to Capitol Media Services, this lawsuit is just one hurdle for Invest in Ed organizers.
