A Maricopa County Superior Court judge Thursday ruled the Invest in Education initiative can be on November’s ballot.
Judge James Smith rejected arguments from the Arizona Chamber of Commerce that since the measure discussed raising the tax rate by “percentage” rather than “percentage points,” voters should be blocked from weighing in.
The judge also ruled the law requiring strict compliance for voter initiatives is unconstitutional. But, a few hours later, the judge in another case — this one dealing with the ballot measure on a new renewable energy mandate — ruled strict compliance is constitutional.
