The Arizona Court of Appeals ruled that a now-divorced woman can implant fertilized embryos despite objections of her ex-husband.
Ruby Torres and her former husband, John Terrill, signed a contract with a fertilization clinic saying that embryos could be used with the “express, written consent” of both parties in case of divorce.
At the time, Torres was undergoing chemotherapy, and now she wants to implant embryos through an in vitro fertilization if and when she remarries. But Terrill, who was the donor, does not consent.
Appellate Judge Jennifer Campbell writes in the court’s decision that Torres can do what she wants with the eggs.
Terrill’s lawyer says he is considering Arizona Supreme Court review.
