Arizona House Leader Wants AG To Declare Statewide Vaping Age Limit

During the last legislative session, Republican efforts to increase the minimum age to 21 for tobacco use failed. That left the decision whether to raise the minimum age to individual municipalities.

Now, another GOP leader has asked Attorney General Mark Brnovich to formally declare those local laws on smoking and vaping illegal and unenforceable.

While lawmakers have not preempted local ordinances, House speaker pro tem T.J. Shope points out there are no state laws authorizing locally made regulations either.

"I would just prefer there be some uniformity," said Shope. "I wanted to see first off if the AG's office consider what was the current patchwork legal or not under the constitution."

If Brnovich were to agree with Shope, it would allow the lawmaker to file a complaint against each city and town in violation.
