Arizona Gov. Doug Ducey’s stay-at-home order goes to court on Friday.
U.S. District Court Judge Murray Snow will hear arguments regarding the constitutional legality of the order.
Ducey’s private attorney says that there is no legal right to the challenge, and that there is sufficient risk to justify the order.
The challenger, Joseph McGhee, is a laid-off restaurant employee who says people have the constitutional right to go outside.
“This specific injury is the fact that essentially the entire state of Arizona is subject to a mass detention in their homes," McGhee said.
Ducey’s attorney argues that the language in the order allows people to exercise constitutionally protected rights if they follow the necessary precautions. But McGhee says the threat of fines and jail time undermines that.
