Valley Gym Owner Plans To Sue Gov. Ducey Over Latest Executive Order

A Valley fitness club plans to sue Gov. Doug Ducey over the  latest executive order requiring gyms to close.

Tom Hatten, CEO of Mountainside Fitness, told reporters Monday that he takes COVID-19 seriously and complied with the state’s previous order. But Hatten questioned why Ducey this time closed gyms, bars and waterparks without closing restaurants, casinos or retail businesses.

“You make a decision for everybody’s life together and we’ll be in full support of that just like we were for the two months that we were closed down," Hatten said.

Hatten said he does not plan to close his business’s 17 locations. The executive order required gyms to close for at least the next 30 days. Mountainside remained open Tuesday.
