President Trump tweeted Thursday morning raising an issue of delaying the election until it is safe for everyone to vote in person.
ASU constitutional law professor Paul Bender said a delayed election date past the end of his four-year term would be unconstitutional.
“The Election Day is not fixed in the Constitution, but he is running for president," said Bender. "And he has a four-year term, and the term is up the 20th of January of next year. So, the election’s gotta happen before then.”
The president has claimed incorrectly that voting by mail leads to fraud. Bender said the tweet appear to be an act of desperation.
