A Maricopa County Superior Court judge said the process Gov. Doug Ducey and the Arizona Department of Health Services set up to give gyms a chance to reopen is lacking but technically complies with an earlier order that there be some process.
That process has worked for two businesses, including EoS Fitness. But Joel Sannes, the attorney for Mountainside Fitness, which has filed suit over the closure of gyms, said it’s not clear how EoS made an acceptable case.
"The process is a black box, and we don't know what is inside the process," Sannes said. "To give you an example, EoS apparently has been allowed to reopen. But we don't know under what terms EoS was allowed to reopen."
The Show spoke with Rob Zelms, the attorney for EoS Fitness, to find out how he was able to navigate the process in a way other gyms and health clubs haven’t.
