Arizona Supreme Court Refuses Case Challenging Ducey's Eviction Ban

The Arizona Supreme Court will not hear a case that challenges Gov. Doug Ducey’s eviction moratorium.

The order, which keeps landlords from evicting tenants who can’t pay their rent because of COVID-19, will remain in effect through at least the end of October, when it is set to expire.

The moratorium still allows some evictions, but the process for removing those tenants has become tricky for landlords.

Two groups, representing landlords and trailer park owners, filed a lawsuit claiming the order unconstitutionally overrules contracts landlords have with their tenants.

But the state’s high court will not hear the case and suggested taking it to a trial court which could take weeks to months.

The Centers for Disease Control and Prevention has also issued its own eviction ban that will last through the end of the year.
