Attorney General Mark Brnovich and Secretary of State Katie Hobbs are asking the 9th U.S. Circuit Court of Appeals to put a hold on the extension of Arizona’s voter registration deadline. Hobbs' had initially decided not to appeal last week's ruling, which extended the deadline. But that put her at odds with 10 of the state's 15 county recorders from both parties.
On Monday, Judge Jay Bybee questioned claims by Mi Familia Vota and the Arizona Coalition for Change. Those groups have said it’s been more difficult for them to get people registered due to the pandemic.
"In terms of being restricted in your ability to register people, there is no state action there," Bybee said. "There is no state action in any of this. There's nothing that Arizona has done, at least nothing that you've alleged, that impeded your ability to register people."
Even if the court overturns last week’s ruling, Hobbs still wants those who registered to vote in the interim, after Oct. 5, to be able to vote.
