Arizona Gov. Doug Ducey has not yet decided on whether to confront the Tucson and Pima County enforced curfew, which are violations to his executive order back in May.
Ducey has been lenient in his order in other areas, such as allowing local governments to impose their own mask mandates.
Pima County Administrator Chuck Huckelberry says Tucson and the county have introduced the curfews because COVID-19 cases are surging and positivity rates have skyrocketed since June.
"Our hospital capacity is probably less than maybe Maricopa. And our infections in their daily count don't seem to be abating. So there's the reason. It's an entirely different universe," Huckelberry said.
Huckelberry also said the curfew from 10 p.m. to 5 a.m. goes after businesses, a more practical approach than regulating individuals. The focus is mostly on prohibiting people from hanging around bars and restaurants past curfew. Essential activity may continue.
