Arizona Supreme Court To Determine Extent Of Immunity Given To State Lawmakers

The Arizona Supreme Court has agreed to determine the extent to which immunity is provided to state lawmakers.

The court will rule whether certain actions by former House Speaker J.D. Mesnard, were legitimate legislative activity. If it does, he is protected from a pending suit. 

Former state Rep. Don Shooterwants to sue Mesnard, claiming he had edited an investigative report that led to Shooter’s 2018 expulsion.

Shooter claims Mesnard removed exculpatory evidence, which concluded Shooter was guilty of sexual harassment. Shooter’s lawyers also say Mesnard’s press release isn’t protected. 

Mesnard’s lawyers denied he altered the report or directed investigators to do so. They claim the report and press release were proper legislative activity.
