Federal Judge Throws Out Arizona AG Brnovich Lawsuit Concerning Deportations

A federal judge has slapped down a bid by Arizona Attorney General Mark Brnovich to get the federal government to take custody of, and deport, within 90 days more people who are in the United States illegally.

U.S. District Court Judge Susan Bolton agreed with Brnovich that the state is incurring costs due to a change in guidelines implemented in January by the Biden administration.

That change was creating a priority list for who to deport first, putting those associated with terrorism and other national secuity issues at the top of the list. 

Brnovich cited a federal law that states anyone with a final order of removal be picked up and deported by Immigration and Customs Enforcement within 90 days.

While the judge acknowledged that 1996 law, she says there is reason to believe the 90-day deadline is just a “target date of removal.” 

The state has filed an appeal.
