Federal Judge Throws Out Brnovich Bid To Use COVID-19 Funds For Tax Cuts

A federal judge has thrown out a bid by Arizona Attorney General Mark Brnovich, effectively backing the rule that money from a COVID-19 federal relief package cannot be used for tax cuts.

The judge ruledthe $4.7 billion in American Rescue Plan Act money allocated to Arizona cannot be used to fund tax cuts.

In her 10-page ruling, Judge Diane Humetewa had thrown out Brnovich’s arguments and concluded that neither Brnovich nor the state has a legal right to challenge the provisions of the Rescue Plan approved earlier this year by Congress.

Brnovich, who has filed a series of lawsuits against the Biden administration, will appeal the ruling.
