Attorneys for the Arizona Department of Corrections are going to appeal an order that would put health care in state prisons on trial.
In a notice filed Monday, the state said it would appeal U.S. District Court Judge Roslyn Silver’s order rescinding a settlement agreed to in 2014.
After years of non-compliance with terms of the settlement, Silver ordered the matter to be resolved with a trial that is scheduled to begin Nov. 1.
The appeal doesn't halt the current proceedings, but depending upon what the state and the courts do next, they could potentially delay the trial.
