The Maricopa County Superior Court will hear arguments in September over whether it was legal for state lawmakers and Gov. Doug Ducey to bar schools from requiring students and staff to wear masks.
Proponents of the suit argue the law banning school mask mandates was improperly enacted and unconstitutional. They say the same legal flaws also invalidate a host of other issues, including banning the teaching of what has been incorrectly labeled as "critical race theory."
These laws were added to the state budget as "budget reconciliation bills," designed to enact changes in state law and policy to conform with the spending plans.
The Sept. 13 court date will give the losing side a chance to quickly seek a Supreme Court review. The law banning school mask mandates takes effect Sept. 29.
