Arizona Attorney General Mark Brnovich is suing the Biden administration over the recent vaccine-mandate covering around 100 million workers.
Brnovich argues that the president is illegally favoring unauthorized migrants by not forcing them to get jabbed.
The Arizona lawsuit tries to use unease over border crossings to argue an unrelated subject, said Muzaffar Chishti, senior fellow for the think-tank Migration Policy Institute.
“It’s trying to make an immigration case from what’s not an immigration case. It’s trying to make a constitutional argument where there isn’t a constitutional argument,” he said.

Brnovich’s main argument is that a clause in the 14th Amendment means the feds can’t force U.S. citizens to get vaccinated when they don’t make migrants do the same. But Biden’s order just applies to certain workers, including any who are undocumented.
Brnovich is running to be Arizona’s Republican nominee for U.S. Senate next year.
