Judge Ends Rapid Border Expulsions Under Title 42

A federal judge today ordered the Biden administration to stop deporting families using a public health policy implemented under former President Donald Trump at the start of the global pandemic. 

The Biden administration kept in place the policy called Title 42. It allowed Customs and Border Protection to rapidly deport people captured along the U.S.-Mexico border back into Mexico as a way to minimize the spread of COVID-19. 

The judge’s order specifically stops CBP from using Title 42 to deport migrant families with children. 

The administration used Title 42 on families in about 20% of its deportations last month. The judge ruled that the policy doesn’t authorize the expulsion of migrants.

The policy must end in 14 days. The U.S. is expected to appeal the decision.
