Arizona Senate President Karen Fann wrote a letter to Cyber Ninjas saying they are in breach of their agreement to audit the 2020 general election in Maricopa County.
Fann wrote the Senate has only received about 300 records from the company, which is an insubstantial amount of what they are holding.
She stated the Senate reserves the rights to pursue every claim to enforce the provisions of the agreement.
She says their inadequate response is in breach of their contract.
Last month, the senate wrote to the company demanding all the records they hold related to the audit.
Austin Evers is the executive director of American Oversight. He says the Senate and Cyber Ninjas have been fighting transparency from the beginning of the process.
“Cyber Ninjas is resisting complying with both a court order directly to turn over records and the state Senate’s request for them to turn records over to the Senate as its agent," Evers said.
A judge is hearing arguments on a contempt hearing today [Thursday] from the Arizona Republic against Cyber Ninjas.
American Oversight has a contempt hearing against the Senate next week.
