Court of Appeals holds hearing on election audit lawsuit

The Court of Appeals held a hearing Wednesday on whether records related to the 2020 Maricopa County General Election audit are protected by legislative privilege

An attorney for the Senate continued to argue to the Court of Appeals that public disclosure of the records would undermine lawmakers ability to do their jobs. 

However Keith Beauchamp, the lawyer for the group American Oversight who is seeking to release the records, says they have nothing to do with the role of crafting laws. He said it has to do with Senate President Karen Fann’s communication on handling the audit with Cyber Ninjas. 

Beachamp added the Senate waived claims of privilege after holding a public hearing on the results of the audit. 

The court’s decision will likely affect the outcome of the parallel lawsuit filed by Phoenix Newspapers Incorporated, who owns the Arizona Republic.
