While state health departments can require quarantines after a governor-granted State of Emergency, those isolations can be challenged.
If a child is sent home to quarantine due to an exposure to COVID-19, parents can challenge that in court with a state-paid lawyer.
State Sen. Kelly Townsend argues a big problem is that not all schools are able to handle such disruptions equally.
"Some would allow for online learning and some would not. They had kids missing large swaths of school from an arbitrary, random, unknown exposure that they didn't establish. And now the child is missing a large amount of education," Townsend said.
Townsend has been a critic of the governor’s response to the pandemic due to restrictions put in place. She tried to push a provision through the Legislature that would limit a governor’s powers, but her measure did not pass in the House.
