On Friday, A Yavapai County judge said a lawsuit brought by Attorney General Mark Brnovich concerning the state’s Election Procedures Manual is flawed.
Judge John Napper said the suit against Secretary of State Katie Hobbs failed to explain why Brnovich’s proposed changes are legally necessary.
"I can't figure out why they need to come out. I can't figure out why the attorney general objects to them. Most of them appear to me to track the statutes and provide guidance on the statutes,” said Napper.
Napper instructed Brnovich to produce a point-by-point list of changes, as well as explanations as to why they’re needed, by May 6.
He also directed that Gov. Doug Ducey be added to the case. Napper said both the attorney general and the governor need to approve the manual.
