Immigration advocates are challenging Title 42. What could lie ahead for migrants and the policy

Title 42 was meant to be a stopgap measure to protect public health at the border when the pandemic hit. But advocates who argue it’s hurting migrants — and denying them their right to seek asylum — are now challenging a judge’s order to keep it in place.

The protocol restricts asylum at the border and has led to thousands of migrants living in limbo — often in dangerous conditions in Mexican border towns. It’s been the subject of debate since it was put into place during the Trump administration, and came under even greater scrutiny when the Biden administration kept it in place as the pandemic began to wind down.

Biden administration officials had set an end date for the program of May 23, but days before the deadline, a federal judge in Louisiana sided with Arizona and other Republican-led states trying to force the health protocol to stay in place. Now, a legal group in California is challenging that ruling.
