U.S. District Court judge allows immigration lawsuit against Biden administration to proceed

A U.S. District Court judge will allow Arizona Attorney General Mark Brnovich to pursue a lawsuit against the Biden administration for some of its immigration policies. 

The state attorney general contends the administration’s policies led to more than 225,000 undocumented individuals being released into the U.S. between the time Biden took office and when Brnovich filed his complaint a year ago. 

He alleges the federal government did not provide those people with documents that initiate removal proceedings. Instead, Brnovich claims they were given a document not listed in immigration laws.

The judge said Brnovich cited concrete and traceable evidence that the state has been damaged by the policies. The claim stems from health care costs spent on undocumented individuals in Arizona after Biden’s policies were put in place. 

A hearing date has not been set.
