The U.S. Supreme Court is judging the legality of the Indian Child Welfare Act

The U.S. Supreme Court earlier this month heard arguments in a case challenging the constitutionality of the Indian Child Welfare Act, or ICWA.

The law sets standards for removing Native American children from their homes, but the challengers in this case — several Texas families looking to adopt Native American children — say the law is essentially a racial preference, which is unconstitutional.

Robert Miller says how the justices rule could have major impacts on Indian law beyond ICWA.

Miller is a professor at Arizona State University's Sandra Day O’Connor College of Law.

The Show spoke with him to learn what could happen.
