How the Supreme Court's ruling over ICE priorities could impact deportations

In 2021, Department of Homeland Security Secretary Alejandro Mayorkas issued a memo to U.S. Immigration and Customs Enforcement (ICE) offices across the country stating the department did not have the resources to pursue all deportations.

ICE should focus deportation efforts on people with criminal records or who, in one way or another, posed a threat to American communities.

This was a stark change to what we saw from the Trump administration, when ICE policy was to deport anyone in the country without documentation.

A number of conservative states opposed the change, and Texas sued over it, arguing it suffered financial damages for migrants the federal authorities didn’t pursue. A federal judge in Texas stopped Mayorkas’ order, and Justices heard arguments in the case Nov. 29.
