Court rules trial is merited between Phoenix and property owners in 'The Zone'

The court battle continues between the city of Phoenix and people who do business or own property in an area known as “The Zone.” A new ruling indicates the case will go to trial.

The city had moved to dismiss the case (CV2022-010439) made by business and property owners in "the Zone," so named for an area west of downtown Phoenix that has an overwhelming amount of homeless encampments. 

But in a ruling on Tuesday, a Maricopa County Superior Court judge denied the city’s arguments for dismissal and said a trial is imminent. No date has been set.

Business and property owners claim the city has mishandled the encampment situation and therefore has violated their constitutional rights, among other complaints.
