Abortion rules are still up in the air in Arizona as two conflicting laws — and the question of which should take precedence — are being debated in court.
The former state attorney general argued that a near-total abortion ban made before Arizona was a state overrules the modern 15-week ban.
But in new filings to the Arizona Supreme Court, Attorney General Kris Mayes refuses to defend the old law and argues if her office takes no interest, then there is no one with legal standing to defend it .
But whether or not the justices agree depends on if they disregard a guardian that the court first appointed 52 years ago, to represent the legal interests of certain fetuses.
The court has not set a date to consider the issue. So the lower court ruling allowing abortions up to 15 weeks still stands.
