A new ruling from the Arizona Court of Appeals has made it harder for groups or individuals to challenge the construction of new billboards.
Some are concerned the ruling could apply to other zoning laws.
The unanimous decision by the three-judge panel said anyone who seeks to overturn board of adjustment approvals has to show they have suffered “particularized harm.”
The judges said that means more than concerns about the aesthetics of an area.
A lawsuit was brought after the billboard company Clear Channel applied to relocate three billboards onto a newly planned tower at Central Avenue and Thomas Road.
The approval of the billboards led to an appeal by the Arcadia Osborn Neighborhood Association.
