Phoenix agency, construction firm settle discrimination case over diabetic worker's snack breaks

The Phoenix District Office on Equal Employment Opportunity Commission sued a construction company for allegedly discriminating and retaliating against a diabetic welder.

Now Cutting Edge Supply will pay the former worker $150,000 to settle the case.

Details of the settlement are in a two year court-enforceable agreement that lets EEOC monitor company compliance with the Americans with Disabilities Act.

EEOC accused Cutting Edge Supply, which does business in Arizona, of denying snack breaks to a welder with diabetes who requested time to regulate his blood sugar.

According to the complaint, Luis Hernandez provided a doctor’s note that was torn up by a manager who later fired him.

The lawsuit also accuses the boss of calling Hernandez a pig for eating when not on break.

Cutting Edge Supply did not immediately respond to a request for comment.
