Tempe sets Aug. 4 meeting on plan to make residential zoning compliant with 2024 law

A state law passed in 2024 requires cities with more than 75,000 residents to allow duplexes, townhomes and other kinds of housing in areas zoned for single-family homes.

Tempe leaders want feedback on a proposal to change city code.

Tempe officials have scheduled an Aug. 4 public meeting to review what they’re calling a middle housing overlay district.

Officials say state law preempts Tempe code on density so duplexes, triplexes, quadplexes and townhomes in eligible areas do not have to meet the city’s requirement.

Tempe also cannot set regulations on those types of homes that are more restrictive than ones made for a single family.

The proposal is set to go before Tempe’s development review commission in September. Public hearings held by the City Council are scheduled for October and November.
