Mayes: AZ law allowing in-state tuition for undocumented students is compliant with federal law

Arizona Attorney General Kris Mayes has issued an opinion clarifying that a voter-approved law that defines in-state tuition eligibility is compliant with federal law.

The state law allows students who meet attendance and graduation requirements to receive in-state tuition regardless of their immigration status.

State Sen. Flavio Bravo, who represents the West Valley, requested the legal opinion after watching Texas and Florida change their requirements. Undocumented students are not eligible for federal financial aid, so Bravo calls in-state tuition’s lower prices a lifeline.

“I wanted to make sure that in Arizona our students and families would have some clarity and especially before the fall semester begins," Bravo said.

He says the law has greater protection from being repealed in Arizona since it is voter-approved.

The CEO of Aliento, which serves students, "Dreamers" and immigrant families, said in a statement that this formal opinion gives school counselors and advisers confirmation to keep encouraging students toward a secondary education.
