A judge ruled Tuesday that the $1 million-a-day voter sweepstakes that Elon Musk’s political action committee is hosting can continue.
But according to Musk’s lawyers, it may not be a sweepstakes at all.
Musk’s lawyers said the winners are paid spokespeople and not chosen by chance.
Since Oct. 19, one eligible voter per day has been selected to receive $1 million. Two of those recipients are from Arizona, including Joshua Carl Offenhartz.
He said he signed the petition that made him eligible for the $1 million. It asks swing state voters to endorse the U.S. Constitution, especially the First and Second amendments.
“As an attorney I believe in due process and prevention of unreasonable search and seizure. As an American, and a Jewish American I believe in the first amendment and the freedom of religion. And as a young father, you want to make the world a better place," Offenhartz said.
On his X page, formerly known as Twitter, Offenhartz says the petition did not sway his vote and his early ballot was received weeks ago.

Also on his page is a nearly 2-minute long video shared by Musk’s America PAC.
In it, Offenhartz says: “As parents to two young children, we want to leave an America behind that is an America that they will recognize, an America where they can grow and find jobs and raise families of their own. And we want to feel safe and confident in that future.”
It’s unclear if this is what Musk’s lawyer meant when he called the recipients spokespeople.
The PAC’s site lists him and other recipients as having “earned” $1 million.
