Lawsuit could jeopardize Arizona rules on cage-free eggs that will take effect in 2025

The fate of state rules designed to provide more humane treatment of laying hens could depend on whether a judge believes a Tucson restaurateur has legal standing to challenge them.

The new rules set to take effect in 2025 would only affect one major Arizona egg producer out of two.

But Attorney John Thorpe with the Goldwater Institute says his client’s ability to buy a product he wants is in jeopardy because the Agriculture Department’s rules will affect any major egg producer that sells eggs in Arizona.

While state officials did estimate a price increase up to 3 cents per egg, they say there’s no evidence prices have been affected by the rules or if producers and retailers absorbed the costs.
